I was told via a letter from Dwp that following my recent (2nd attempt) medical, i do not have any limited capability for work, and am no longer getting income related Esa . This was my one and only source of income .
My dla was also withdrawn after the doctor who took over from my old one, could not be botherd to write out any details of my mental and physical state on the form sent to him.. I am as they say, Up sh-t creek without a paddle!.. Believe me, this has not yet even begun to Sink in.

Have you been to mind or citizens advice and had someone advocate for you? Or been to a solicitor. Can you appeal and go to a tribunal?

Appeal as soon as you can, you have a much better chance at tribunal as they actually look at the medical evidence. I agree with Wiseowl, speak to someone from the CAB, Mind or welfare right, they will be able to guide you through the appeals process.

Good luck.

*thankyou* to wiseowl and piglet.. I spoke to someone yesterday about the Esa and the they are sending out an appeal form.
I am just wondering now whether or not I should be putting in an application for Jsa, as I have absolutely NOTHING else coming in.. My money was stopped at the start of the month, and i have only just received notification. :(
thankyou for your suggestions, i would like to get further help and understanding on this situation x

Don't put in an application for JSA it'll undermine your appeal. I would apply for income support.

I assume you're already getting housing benefit and council tax benefit? If not income support is a passport benefit and will automatically mean you qualify for them as will as free prescriptions. I would also apply for a budgeting loan while your claim is being sorted
http://www.direct.gov.uk/en/moneytaxandbenefits/benefitstaxcreditsandothersupport/on_a_low_income/dg_10018905

I would also advise you to ring or go in person to talk to citizens advise bureau and mind. Both of which will be able to advise you on your rights and any other help avaliable.

It might be worth finding out where your local food banks are and if you qualify for a food package, just to tide you over.

Also if you do get income support but struggle to make ends meet while the appeal goes through and need a loan (if you are awarded ESA it should be backdated) try your local credit union. They offer competitive rates, are properly regulated and will consider unemployed people. It's much better than turning to payday loans.

I hope this helps :)

No problem Unloved thank you for your kind words. I was feeling a bit miserable and emotional tonight and you've made me smile, thank you :)

Anything to counter the bad advice the DWP/Atos give.

Thanks :) . I hope the CAB are able to help, if you don't find that useful try MIND. Wishing you lots of luck.

I'm okay just had the flu for a week and it's made me feel a bit depressed because I've been at home by myself with only my negative thoughts for company. I'll feel better when I'm back at college next week.

Take care x

Have you looked at the 'Benefits and Work' website? It's so helpful and guides you through the minefield that is now our Welfare system. I'm using it for an ESA appeal and it's taken the stress and guesswork out of it.

morning wiseowl :) i hope you have plenty of Lemsips to help you atm.? Anything that attacks ur immune system sucks the life out of you, so its no wonder if you feel under the weather.. really hope you are taking good care of yourself, and eating good food to help you keep going x.

it was along day yesterday, had to go to the CAB twice.. The adviser took details and asked me some of the 'point scoring questions' to see if I would score enough points.. She said she could see how i was (Physically) ..and couldnt understand Why I had been turned down..
She also rang the Esa and confirmed that i would be appealing.. she said that they would be writing a letter- which my neighbour will be collecting monday.
*But I also need Help appealling the withdrawall of my DLA .. for which time is running out, (if it hasnt already!) .. So on Monday i am hoping i may be able to ask for their help on this also?..
*just to make things more Complicated, my new doctors surgery STILL havent received my health records! ..i am supposed to be sending in a doctors letter to support my Esa appeal.. :s
-so yesterday, i took my last two Dla forms (completed by my two previous doctors), up to the new Surgery, and made a 'double appointment' for Tuesday, -hopefully so can explain things further an get some Help?.. Also i managed to contact my local PCT just before they Closed! To ask them again if they could chase-up my missing medical records..

also the lady at the CAB told me yesterday, it would be far better to attend the Appeal for my Esa in person.. Which probably wont be for atleast another 6 mnths or so.
i do understand why, but the thought alone Terrifies the absolute cr-p out of me.. Infact every step of this process, with the benefits people and my new doctors is haunting me at every turn,! .. Although i can see just how the government are making genuine people 'fight' for their own financial support and future wellbeing.. I can also trully understand the whole process as being a 'double edged sword' that impacts further Negetavity onto each individuals Health.. I really wish I was back in work to honest! But i know ive got to scrape my way bk up xx.

As Losingtheplot said try that website and contact her. Also I strongly recommend you visit MIND, because they might be able to get someone to come with you to the appeal, which might make you feel a bit less anxious. Also depending on your area MIND might be able to offer you mental health support while you are dealing with this counselling or support groups. They also tend to know everything else that's available in your area.

Thanks for your post :). I'm near the end of it now but I feel exhausted got some college work I need to do, so going to tackle that today. The best thing at the minute is blackcurrant cordial I am so thirsty all the time and it's nice on my throat. I'm also trying a natural remedy sombucol (have to take it all the time even when not sick) to help improve my immune system. I'm sick of getting ill all the time.

It's really brilliant that you've gone to CAB it's not easy having to fight for help all the time when you feel bad, so well done!
