Wow, i just got the letter from the DWP. and yep it scored me zero points on all counts... Even the counts where in the brief that the health care professional observed pain and discomfort in in various cases of the tests....

And it completely ignored my mental health... It takes mentions of my attempted suicides and says that i score zero points... Im actually shaking with a mixture of rage and fear right now after reading that....

It seems to boil mostly down to the fact that I am fairly independent... I can cook for myself and go shopping... ride a motorbike.... but NONE of that has anything to do with fragility of mental health... How the utter crap can the assessor come up with this .... im lost for words.

Oh and because im polite and had good eye contact, that surely must mean i cant possibly be autistic or have severer anxiety and depression... or could it possibly be because im PDA.... which if anyone knows... PDA affected people mask the anxiety and learn to fake confidence.... oh jesus....

if i was you i'd get welfare advice from someone, i know easier said than done most charities and places don't want to offer it and be seen as aiding and abetting scroungers in the present political enviroment

They don't want you to have money when there's aircraft and railray tracks to pay for sinking their budgets....imagine if they didn't save a couple a minutes here and there?

Just heard back from DWP and yet again they have declined to give me ESA... They said I the main reason was because I didnt directly reference or counter act the original decision makers reason or something... How the fuck could I do that? i didnt have those details I was talking to some one on the phone.

I how have no choice. I have to go onto UC and try and find work.... But I just know its all going to fuck up.

If I were you I would put in your Mandatory Reconsideration (MR) in as soon as possible. Write down all the reasons why you want a reconsideration including all the feelings that you have regarding your mental health and how this process has affected you to such an extent that it has caused you great distress and made you condition worse.
The Citizens Advise Bureau are excellent helping with MR applications but remember you only have one month to do it after your decision letter. How to ask for an MR should be detailed in your letter from DWP.
If your MR is not upheld you then have to go for an appeal which may take up to a year. Look on this website Challenging an ESA decision - mandatory reconsideration for more information as it is very useful.
Also I know you have had some very unhelpful DWP telephony staff another option is going to your local jobcentre and ask for an appointment to see an ESA workcoach. They are trained in ESA and very supportive of your situation (or should be). Also this has the benefit of being able to see your records. It is true that if you were on Income related ESA prior to this decision then Universal Credit may be the way forward. However please do not be put off by all the horror stories, this is an income whilst you wait for the ESA decision and if upheld on appeal the original amount will be reinstated. Universal Credit has replaced ESA/JSA and IS and eventually all will be on it. You can apply for it whilst the process is ongoing and supply fitnotes (ie sicknotes from your doctor). Again I would advice to go to the jobcentre and CAB to get further advice.
Also please apply for PIP as they are totally independent benefits of each other, the number is 0800 917 2222 and they do take into account mental health as well as physical.

I did put in the MR via the phone with the DWP rep.... I already mentioned here.... They still ignored all mental health issues and kept me cut off...

Thats it. Nothing left i can do. I cant take DWP to court...

That is exactly what you can do hun, get an appeal in it is a sscs1 form - https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/748554/sscs1-eng.pdf.
Also as said before go to your local jobcentre and ask for an ESA workcoach for help or help in applying for UC and declare on the application that you are currently unfit for work, get a fit note and you will be sent for another Work Capability Assessment however you will not have to look for work until that happens. Mention to them that you are appealing your ESA decision.
Get help from the CAB (citizens advice) in completing your form and if you need any help, I am here x

Its too late for that ive had to sign up to JSA on UC... I cant just get a new sick note and go back onto esa as ive just been dropped... Even though i have a letter from the doctor explaining my mental health they dont care...


I cant go through the court process Thats just it, i have to try and find work and hope nothing goes wrong... But I know it wont last. Ive given up trying....

You don't have to do anything to go through the process apart from completing the form. And you can get a new sick when you go on UC, just believe me I know this. Any problems let me know.x

But I would have to go to a tribunal, a court room and explain my problems and there backgrounds... Theres simply no way i can go through all that
